• The Lafayette, IN government has released no such images into the public domain, and a replacement image could not be created that would adequately provide the same information
• The image is being used for no purpose other than to identify the subject of the article
• The image is used as the primary means of a visual identification of the article topic
• The use of this image does not detract from the City of Lafayette, nor is it used in such a way that a reader would be confused into believe that the article is written or authorized by the City of Lafayette
