The article it is being used in (Serenity (Firefly episode)) describes the introduction of the characters in the pilot and this is Wash's first appearance;
This image has no salable value in reproduction and therefore is not a risk of illegal reproduction and distribution;
It is believed that screencaptures of copyrighted TV shows can be used for discussion of the material.
