[edit] Licensing
This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution images of such covers
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |

---|---|
Description |
Album cover |
Source |
Derived from a scan of the album cover (creator of this digital version is irrelevant as the copyright in all equivalent images is still held by the same party) Copyright held by the record company or the artist. Claimed as fair use regardless. |
Article | |
Portion used |
Entire front cover, but does not include back or insides of original artwork or audio content on the album |
Low resolution? |
Is only as much resolution is necessary to identify and show the style of artwork used for the article, not enough to be used for piracy |
Purpose of use |
Illustrates the appearance of the album and identifies it by recognized features |
Replaceable? |
no free equivalent can equal this image (any would be a derivative of this artwork) |
Other information | Image in this form is already widely distributed to identify the album as part of catalogs and reviews, so we degrade no market value by providing it ourselves |
[edit] Fair use rationale
Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
- It is a low resolution copy of an album cover.
- The image is only a small portion of the commercial product.
- The use of the cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original album.
- It illustrates educational articles about the album from which the cover illustration was taken.
- The image is used as the primary means of visual identification of topics in the article. For an article about an album or artist, the cover artwork is very important and adds significantly to the article.
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
