  • The image is irreplaceable; a free analogue is impossible to produce.
  • Only a small portion of a copyrighted work is used.
  • The image is used solely to illustrate the audio recording in question.
  • The use of this image does not compete with the copyright holders' usage.
  • The image is of inferior quality compared to that of an original, having been reduced to web-resolution.
