Original caption: "STUDENT OF STERILIZATION: Long interested in philanthropy, and in race-improvement, Mr. E. S. Gosney initiated in 1925 a study of the actual effects of the California law during the fifteen years it had been in operation. This study has continued since that time, and has made available more facts about the effects of such a law than are elsewhere to be found. To provide for the continuance of this work Mr. Gosney has incorporated and endowed the Human Betterment Foundation."

The copyright of this picture was likely held by the Human Betterment Foundation, and is now likely held by the California Institute of Technology. A similar picture is available for licensing from the Caltech's historical archives. The American Philosophical Society lists this picture as one of its holdings ([1]) though their scan is also clearly from the same article as this one. It may be part of the archives of the American Eugenics Society in that instance but it hard to tell for sure.

I believe it satisfies Wikipedia's fair use criteria because:

  1. It is low-resolution and does not encourage copyright violation. No loss of value deemed likely.
  2. The copyright holder has been noted as best as possible.
  3. It serves the purpose of illustrating a notable and important historical article used on the English Wikipedia for educational purposes.
  4. There are not likely any free alternatives, and in any case none have been found.
