[edit] Fair use in Sparkle and Fade
Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
- It illustrates an educational article about the entity that the image represents.
- The image is used as the primary means of visual identification of the article topic.
- It is a low resolution image, and thus not suitable for production of counterfeit goods.
- The image is not used in such a way the a reader would be confused into believing that the article is written or authorized by the owner of the image.
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
This boilerplate rationale was added as a silent protest against the overreaching actions of BetacommandBot. Countless images will be unnecessarily removed due to this bot. As its owner has no intentions of stopping the bot, this boilerplate rationale will have to suffice.
[edit] Licensing
This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution images of such covers
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. |
