[edit] Fair use in E.T. the Extra-Terrestrial (Atari 2600)
It is believed that this image failed under being fair use for the following reasons:
- Atari has not released any screenshots into the public domain;
- It serves to illustrate the game in question;
- It serves to identify E.T., Elliot, the wells, Reese's Pieces, and the Easter egg;
- The image does not limit the copyright owners' rights to distribute the video game in any way;
- The image is being used for informational purposes only;
- Its use is not believed to detract from the original game in any way;
- Its use does not infringe on Atari's ability to sell the game, which is old and hasn't been sold by Atari in decades.
- Atari doesn't want it and has dumped it in a landfill. That's sorta like giving up copyright.

This is a screenshot of a non-free copyrighted video or computer game, and the copyright for it is most likely held by the company or person that developed the game. It is believed that the use of a limited number of web-resolution screenshots
