Is ESpew legal?

Actually, eSpew is just as legal as Google, MSN, Yahoo, etc. Search engines, irregardless if your discussing Google, Yahoo, etc., all use advanced technology to spider publicly published domains and catalog that data of websites, text, pictures, media, etc., into their database - which allows the respective search engines to provide intelligent results to our user queries. We all understand that the internet is a "city with no maps" without search engines.


Imagine the world today without search engine similar to Google. How would you find and access websites based on keywords?


Every website published on the web includes a (c) for copyright on it. However, Google spiders and even republishs the keywords of those websites. Just like any news media source (written, electronic, etc) the source of the text owns the copyrights. Theoretically, Google is infringing upon those rights by republishing the text in their search engine results. This has gone to court and Google won.


So eSpew display music. The music is not on eSpew's servers. So from a legal point of view, eSpew is really no different than Google.

Google doesnt own the copyrights to the images of their search engine, and yet pictures enjoy the same exact copyright protection as music. Copyright laws we're not written specifically for music.


Yet Google has no contracts with the websites hosting the images, and yet Google copys the original images (creating thumbnails of the images) and displays the images in Google's search engine as if they we're their own.


The internet has changed the dynamics of "intellectual property" and "copyrights" forever. There is no going backwards.


Before we get into a moral conversation about copyrights, allow me to remind you that every time your computer connects to the internet, your theoretically breaking copyright laws.


Again, every website that you visit has a (c) for copyright on it. So when you go to Yahoo.com, and your computer automatically copies and stores all of the pictures, text, etc., from Yahoo, your actually engaging in a "crime".

Image:ESpewLogo.gif is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in Wikipedia articles constitutes fair use. In addition to the boilerplate fair use template, you must also write out on the image description page a specific explanation or rationale for why using this image in each article is consistent with fair use.

Please go to the image description page and edit it to include a fair use rationale. Using one of the templates at Wikipedia:Fair use rationale guideline is an easy way to insure that your image is in compliance with Wikipedia policy, but remember that you must complete the template. Do not simply insert a blank template on an image page.


The legality of eSpew is different according to the country you live in. Assuming you live in Germany I can say eSpew is legal because eSpew just searches the web and is distributing links - and not the mp3s themselves. The use of eSpew for searching and downloading of copyrighted music is illegal. --Dharion 14:52, 10 March 2007 (UTC)
