The Noncommercial nature of the license means that for the purposes of Wikipedia, this image is considered non-free, and so requires a Fair Use rationale for each appearance in an article in order to remain on the site.

[edit] Fair Use rationale for Erfworld

  • It is believed that the use of a single comic panel on the English-language Wikipedia to illustrate an article on the comic in question falls under the "Non-profit educational" clause of the Fair Use doctrine currently upheld by United States law. (17 U.S.C. § 107)
  • The image is irreplaceable; a free analogue is impossible to produce as the original will be covered by copyright for the foreseeable future. The owners of the copyright have demonstrated no interest in providing a commercially distributable version.
  • Owing to the single-panel nature of the image, only a small portion of the copyrighted work (a multi-page graphic novel) is used.
  • The limited web-resolution of the image means that portion of the copyrighted work used to illustrate the article is of inherently lower quality than the original, reducing the risk of competitiveness and therefore the mitigating the potential effects of this copy on the market for or value of versions held by the owner of the copyright.
