Elham Battayav is one of the sixteen Guantanamo captives whose amalgamated habeas corpus submissions were heard by US District Court Judge Reggie B. Walton on January 31, 2007.[1]

The Department of Defense initially planned to keep the identities of the Guantanamo captives secret. But the DoD was forced, by court order to release a list of the captive's names on May 15, 2006.[2] Elham Battayav is notable because even though he is clearly in detention in Guantanamo his name is missing from the official lists, at least by that spelling.

The official list does contain an individual named Ilkham Turdbyavich Batayev.[2]
