I'm confused about the copyright status of your recently added picture of Alex Chilton. Did you get permission from Bar/None to repost this under GFDL? Or are you Bar/None? or what? -- Jmabel 22:08, Jun 15, 2004 (UTC)

The email address from which you wrote me doesn't seem to accept my response, so I am replying here again.

Generally, there isn't any "fair use" on a posed portrait like this. I have no idea whether Bar/None and the unnamed sales site received appropriate permission to use the photo, but their posting it does not change its status. Wikipedia tries to be scrupulous about copyright. Some things are clearly OK: by longstanding tradition, a small image of a book jacket or album cover is fair use. However, a portrait like this is generally off limits unless we can get explicit rights (or if it's old enough to be out of copyright, which any portrait of Alex Chilton clearly is not).

Bar/None may have legitimate rights to the photo and may be happy we are using it; it would be perfectly appropriate to ask them for permission. And they should understand the nature of GFDL and what they are giving permission for.

If no such permission has been obtained, though, the presence of the GDFL boilerplate to the image page seems totally out of line.

You might want to look into the sort of copyright issues that routinely arise on Wikipedia. At any given time, there are typically hundreds of articles and images that are in the process of being removed as probable copyright violations.
