The photo was scanned by user Malick78 from a 1930 theatre programme. The photo is used in it without attribution - therefore no copyright was claimed. It's use in the article however comes under fair-use criteria since the building is no longer in the form shown (an etching from 1870), its use illustrates the article, and no other photos of it to my knowledge are in the public domain.
