4. The image is used and only to illustrate the style of the television advertisement, Don't Copy That Floppy, which could not be as effectively illustrated in any way other than through screenshots;
5. The image is a small, low resolution screenshot of the original television advertisement, which was disseminated via public broadcast, was never marketed for commercial purposes, and continues to be distributed for free; therefore this use can not affect the commercial value of the original television advertisement.
