Publicity shot of Dermot Morgan promoting Fr. Ted which I have had on disk for some time. It was issued as a publicity photo for the Fr. Ted series. As with such publicity shots issued in press packs no restrictions whatsoever were placed on its usage, nor even the slightest suggestion of a restriction or a request that the location of its use be shown either prior or post publication to the agency. As a generally issued publicity shot it would qualify as fair use. Given the unrestricted manner in which it was issued (a standard availability in promotion), there are no grounds whatsoever in any case for thinking that it might be copyright.

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
- It is an image of a notable individual who is deceased in the role for which he is most famous.
- It is of much lower resolution than the original (copies made from it will be of very inferior quality)
- The image is only being used for informational purposes.
- Its inclusion in the article adds significantly to the article because it shows the subject of this article.

- It illustrates an educational article about the character.
- The image is used as the primary means of visual identification of the article topic.

- It is a low resolution image.
- The image is only a small portion of the commercial product.
- It does not limit the copyright owner's rights to sell, produce, or advertise the show in any way.
