- There is no evidence that De Forest Phonofilms motion pictures were distributed in the United States with copyright notice, as then required.
- A search of copyright renewal records for 1950 through 1955 reveals no evidence that any corporate heirs to the immediate corporate heir of the corporate author of the work—British Sound Film Productions—renewed copyrights to any U.S. De Forest Phonofilms motion pictures as would have been required to maintain copyright protection, if any.
- There is no evidence that any entity claims copyright on the image or any film that might have included it.
