District 28 was divided into two single-member districts in 1991. These districts were eliminated in 1997 and representatives were elected at-large.[14]. In 2000, the U.S. Department of Justice sued[15] alleging the change diluted Native American voting rights. Single member districts were restored in 2001.

[edit] Districts 26A and 26B

District 26 was divided into two single-member districts in December 2005[16] after a lawsuit was filed by several Native American individuals alleging voter discrimination in the make up of Districts 27 and 26. In 2005, Judge Karen E. Schreier of the U.S. District Court for South Dakota ruled in favor of the plantiffs and ordered the South Dakota Legislature to redraw the boundaries of Districts 27 and 26 to more accurately reflect the Native American population in those areas. That order was upheld on appeal to the Eighth Circuit [17]
