It is contended that the use of this image qualifies as fair use when used in the article on Dayton's for the following reasons.

1. This image is copyrighted and there is no non-copyrighted version of this image available.

3. This image enhances the article in which it's displayed, as it provides an immediate relevance to the reader more capably than the textual description alone.
