The use of the image linked here (DaveMelillo_TalkIsCheap.jpg) in the Wikipedia article Talk Is Cheap (EP) is claimed to be under fair use as:

The image is only used for nonprofit educational purposes, for identification and/or critical commentary on the copyrighted work.
It is an image representing only the cover and not the actual content of the product in question.
The image is of a resolution far inferior to that of the original, and due to the resulting lack of detail it could not be used for media piracy (e.g. to manufacture illegal copies of the product).
