constitutes Fair Use under US copyright law because: 1) The image (photograph from original poster) is of low quality 2) The illustrated poster was widely distributed, at no cost, as advertising material 3) Use of the image does not compete with any for-profit purposes 4) The products advertised are no longer on the market. 5) The company that is the probable copyright holder (Crossgen Comics) is no longer in business.
