[edit] Summary
http://www.traces-cl.com/mar05/covertraces.jpg
This image is of a magazine cover, and the copyright for it is most likely owned by either the publisher of the magazine or the individual contributors who worked on the cover depicted. It is believed that the use of low-resolution images of magazine covers
on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Non-free content for more information. To the uploader: please add a detailed fair use rationale for each use as well as the source of the work and copyright information. |
{{ subst:Used for purposes of illustration in an educational article about Luigi Giussani. The image shows the first memorial issue of Giussani by Traces Magazine published by Communion and Liberation, which he founded. Replaceable? Protected by copyright, therefore a free use alternative won't exist. | [Luigi Giussani] | Traces Magazine}}
[edit] Fair Use Rationale
This image, Covertraces.jpg, is being linked to in the Wikipedia article Luigi Giussani. Though the picture is subject to copyright, it is covered by the U.S. fair use laws because:
- According to the Wikipedia fair use policy, although it is not generally acceptable to use an image of a magazine cover solely to illustrate the article on the person whose photograph is on the cover, "if that magazine issue itself is notable enough to be a topic within the article, then fair use may apply."
- In this particular case I believe fair use does apply, since this particular magazine cover (1) This issue marks the death of Msgr. Giussani; (2) it contains articles by John Paul II, Joseph Ratzinger, Diogini Tettamanzi, Carlo Maria Martini and Julián Carrón responding to the death of Giussani.; (3) it shows the historical response of the Communion and Liberation movement, which he founded, at the time of his death. These points are relevant enough to be topics in the article about Giussani.
