  • Image:Scientolo Symbol 3.jpg (history · last edit) from offline hard copy. Uploader has created image with the intention of using it in a template, in the apparent (and erroneous) belief that taking a picture of a copyrighted image removes the copyright - see [15]. However, legal advice (as discussed at Template talk:ScientologySeries/Archive 2#Logo removal) is that this image cannot be used in a template as this does not satisfy fair use requirements. The image is therefore incapable of being used in the place for which it was produced and is redundant elsewhere, as there is an existing and better quality Image:Scientology new style logo.png to illustrate the subject matter. [Added] Also, the image is improperly labelled as PD - it should be labelled as fair use given the focus on the copyrighted logo. ChrisO 22:51, 7 July 2007 (UTC)
    comment - this is under debate (or would be) - ChrisO has protected the template from where this image originates, despite the uploader's valid argument using Wiki policy. To say that there was a previous discussion as grounds of preventing a new one is counter-productive. Sfacets 22:57, 7 July 2007 (UTC)
    The previous discussion was on the basis of legal advice from an expert, namely Jean-Baptiste Soufron, who has advised the Wikimedia Foundation on legal issues including copyright. When Foundation lawyers have provided guidance the debate is over. This isn't an issue that can or will be re-opened. -- ChrisO 23:01, 7 July 2007 (UTC)
