    • Netscott appears to be attempting to game the system here; see Wikipedia talk:Copyright problems#Antisemitism image for more. About the image itself, the image is licensed under cc-by, but the subject of the image (the poster) is copyrighted. This is a similar situation to Image:Calder Flamingo.jpg, where the photo is available under a free license, but it may be considered a "derivative work", and therefore the copyright of the subject must be respected as well. As such, a fair use rationalle should be given -- but this is not a "fair use" image. It's not a "non-free" image; it is a cc-by image. It's the poster that we're claiming fair use about. Or consider Image:5meo amt sample dea1.jpg. The photo was created by the U.S. government, so the photo is PD, but the subject (the pot leaf design) may presumably be copyrighted. It is not necessary to fulfill all fair use criteria. (We don't have to provide the name of the artist who drew the pot leaf, for example.) WP:FUC applies to "any non-free media used on Wikipedia", but this photo is cc-by. So I don't think it applies. – Quadell (talk) (bounties) 14:58, 1 September 2006 (UTC)
