[edit] Summary

This is a reduced / cropped digital scan I made of a widespread Conan sketch / painting by artist Mark Schultz. I believe that given the small (298 pixels in width) size of the image, 256 web resolution (GIF) and encyclopedic usage, this image may be utilized for Wikipedia under Fair Use. Note that this same sketch / painting, albeit at a much larger size, may be found on Google, Amazon.com and public websites promoting / illustrating the work of Mr. Schultz; in particular, his Conan illustrations for Del Rey.

After carefully browsing the Wikipedia copyright categories, I have selected "a single panel from the interior of a single issue of a comic book" as being the closest to what this image qualifies as. More correctly, this image is a panel not from a comic book, but a digital scan from The Coming of Conan the Cimmerian, an illustrated novel containing the unedited Conan stories of Robert E. Howard.

Feel free to update the licensing category I selected for this image if you believe there is a more appropriate Wikipedia copyright category.

[edit] Fair use rationale

  • This is a famous image of the character in question.
  • The image is used here for encyclopedic purposes and in no way limits the ability of the artist(s) to market their product.
  • The image is presented as a low resolution copy of the original.
  • The image was released to the media via the internet to promote the original product in which it appeared.
  • The image is arguably significant and was created by a notable artist: Mark Schultz.
  • No free alternative can exist given that Conan and Hyboria are trademarked and thus protected.

[edit] Note concerning Conan and Hyboria

In the United Kingdom and many other countries, the stories, elements and characters created by an author enter the public domain 70 years after their death. The creator of Conan and Hyboria, Robert E. Howard, died in 1936. His original stories, ideas, characters, and elements, including those featuring Conan the Barbarian and Hyboria, become part of the UK public domain as of January 1, 2007. No publisher may claim rights to his material. His stories and the characters portrayed within them, including Conan the Barbarian, are public property, free for any and all to use as they wish.
