It is asserted that the use of this image on pertaining to or in reference to the Communist Party of Ireland (CPI) qualifies as fair use for the following reasons:

It is a low-resolution copy of the logo;
It does not affect the market for the original work — this is a logo created to promote a political party, not a commercial work sold to the public for profit;
By the nature of the image, no free alternative is possible;
The logo is widely identified with the CPI via posters, election literature, advertisements etc. and so the inclusion of the logo adds significantly to the article
