[edit] Under what jurisdiction?

As I understand it, supported by International Court of Justice#Contentious issues (adversarial proceedings) there are several circumstances when the ICJ has jurisdicion. These are namely 1) When both parties agree to take this specific case to the ICJ 2) When an existing international treaty mandates that disputes are taken to the ICJ (fairly rare nowadays) 3) When at least one party has previously agreed to be bound by the ICJ for these matters and the other party brings a dispute.
