Cheeser1 has removed the ShouldBePNG tag from this image twice now, saying, "derivative works of a copyrighted logo would violate fair use". First, the ShouldBePNG tag is not requesting a derivative work; it is requesting this same work in a different format. In particular, it is not asking for this JPEG version to be converted to a PNG, because that would defeat the purpose (the JPEG compression artifacts would still exist, and the file size would likely be much larger). Second, nowhere in the non-free content criteria does it say that derivative works are in violation of Wikipedia policy. The only relevant point is number 4 (previous publication), but that is irrelevant when the only issue is the image format. Third, such a minor change as cropping or changing the image format probably in general does not create a derivative work, but is likely considered to be the original work itself. In fact, item 3(b) of the non-free content criteria, minimal extent of use, actually encourages the cropping and excerpting from copyrighted works rather than using the same thing; surely that is more of a "derivative" than the same work in a different image format. —Bkell (talk) 20:12, 23 March 2008 (UTC)

First of all, I removed the first request to upgrade the image to SVG because SVG would represent a clear breach of WP:FU. I removed the re-insertion of a similar template on those grounds, and yes I was mistaken because the templates are so similar, but I will remind everyone that such a PNG would require a non jpeg source to exist, and it is not entirely clear if such a thing exists (at least, for us to use). --Cheeser1 (talk) 21:08, 23 March 2008 (UTC)
There was never a request for an SVG. The first tag applied to this image was {{badJPEG}}, which merely says that JPEG is inappropriate. The second tag applied is {{ShouldBePNG}}. You're right, though, that we need a non-JPEG source, but I think it is clear that a non-JPEG version should exist somewhere (unquestionably Colgate University has the logo in many forms; maybe there's something at gocolgateraiders.com). I'm not sure what "for us to use" is supposed to mean. We are already using this image without any sort of permission from the copyright holder. —Bkell (talk) 22:52, 23 March 2008 (UTC)
I doubt the school will be releasing the source materials of its logos (or graphics, website, IT systems, or anything else) for anyone to pick apart, boil down to fair-use size, and then post on Wikipedia. --Cheeser1 (talk) 22:56, 23 March 2008 (UTC)
