It is believed that the use of this photo in The Colbert Report qualifies as fair use because:
- it identifies the host of the show, Stephen Colbert;
- it is used for critical commentary regarding the naming contest;
- no adequate free alternative is availible.
- It does not limit the copyright owners rights in any way on the non-profit Wikimedia Foundations The Colbert Report article.
