Though this image is subject to copyright, I feel its use is covered by the U.S. fair use laws because:

  1. It is a low resolution copy of a DVD cover.
  2. It does not limit the copyright owner's rights to sell the DVD in any way.
  3. Copies could not be used to make illegal copies of the artwork on another DVD.
  4. All the resources in the world could not come up with an adequate free use image to illustrate this.
  5. The image on the cover is significant because it was made by a famous artist.

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. The image is only a small portion of the overall product and serves as an easily identifiable part of a larger entity.
  2. The copy of the image is low-resolution and will not produce high-quality copies of the art for illegal duplication. The quality is high enough to clearly present the image and to place the subject represented by the image in a good light.
  3. The use of the image will not affect the value of the original work or limit the copyright holder's rights or ability to gain commercially from the work.
  4. It illustrates educational articles about the subject represented by the image.
  5. The image is used as the primary means of visual identification of topics in the article.
  6. It adds significantly to the article because it illustrates the cover of the DVD of a well known drummer, Ted Kirkpatrick.
