All cuban images before 1997 are considered in Public Domain as they did not sign the Berne Convention pact until 1997 that other wise would have made images like this a copyvio, and that is clearly a pre-1997 image. And if this image came from the Soviet Union, it's soviet PD because Khrushchev died in 1971 so this is a pre-1973 image, and all soviet union images before 1973 are in Public Domain.
I can't speak to the accuracy of the previous paragraph, but I happen to know Marty Lederhandler, the photographer. He was working for the Associated Press when he took this picture, and I believe it was taken at the United Nations. That said, I believe that it falls under fair use because of its historical importance: It illustrates an important relationship between two very significant figures.Danfrog 00:32, 18 October 2007 (UTC)

While the image is not free and copyright belongs to the Marty Lederhandler, I, Alex Bakharev (talk), believe that using the low quality copy of the image to illustrate Foreign relations of Cuba, Cold War (1953–1962), Cuban-Soviet relations and Russian political jokes wikipedia articles constitutes valid fair use:
- It was quite famous in the Soviet block and significantly influenced the perception of the Cuban-Soviet relations
- The image is quite old and does not have much of commercial value
- The image is irreplaceable as it is historic
