I believe this image to be fair use for the following reasons.
- Carol Park is dead, so providing a free alternative would be impossible.
- The image is available freely on the BBC website, and was provided to them by the copyright holder.
- This is one of the few available images of Carol Park, and a picture of her would add significantly to the Lady in the Lake trial article.
- The image has minimal commercial value.
- The image is no larger than it needs to be to convey the intended information.
