I believe this image to be fair use for the following reasons.

Carol Park is dead, so providing a free alternative would be impossible.
The image is available freely on the BBC website, and was provided to them by the copyright holder.
This is one of the few available images of Carol Park, and a picture of her would add significantly to the Lady in the Lake trial article.
The image has minimal commercial value.
The image is no larger than it needs to be to convey the intended information.
