[edit] Rationale of fair use for Captain America and Reb Brown
The image Image:Captainamerica1.gif is being linked here; though the picture is originally copyright, I (Lajbi Holla @ meWho's the boss?) feel it is covered by fair use because:
- The image is a screenshot of TV-movie originally created by Universal TV, and intended for wide distribution (aired by CBS).
- The screenshot is of lower resolution and quality than the TV film.
- No free or public domain images have been located for the TV film.
- The screenshot does not limit the copyright owners' rights to distribute the TV movie in any way.
- The screenshot is intended to represent the TV film of Captain America and Reb Brown in person.
- The screenshot is being used for informational purposes only, and its use is not believed to detract from the original TV movie in any way.
- Screenshots, posters and covers were presented in various websites (like www.beyondhollywood.com).
[edit] Licensing
This image is a screenshot of a copyrighted television program or station ID. As such, the copyright for it is most likely owned by the company or corporation that produced it. It is believed that the use of a limited number of web-resolution screenshots
qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, might be copyright infringement. For more information, see Wikipedia:Non-free content. |
