This is a photo taken of the album cover, and as a copy of a 2-d image, no copyright is extended to the photographer, hence the web site that this was taken from, has no claim of copyright. Only MCA Canada is believed to be copyright holder (or the band itself). Given the size and nature of the photo, there's no potential for commercial competition with the copyright holder.
