From Wikipedia, the free encyclopedia

[edit] Summary

Scanned Canadian cigarette package, showing the exterior.

This scan is given freely to the public domain. The image of the brand is probably fair use; the warning image was developed by the Canadian government.

Note the "Toxic Emissions/Unit" table on the side of the package.

[edit] Fair use in Tobacco packaging warning messages

While this image is copyrighted, I believe it qualifies as fair use under U.S. copyright law because:

  • It illustrates the Canadian warning label on an actual package of cigarettes
  • The warning is a work of the Canadian government, and I assume the Canadian government is not making any money off putting the label on cigarette packages.
  • No free equivalent could be created
  • Use on Wikipedia does not limit the ability to market Number 7 cigarettes, except insofar as the warning label discourages people from smoking.
