As an inset from the cover of the single, it is a minor portion of a photograph of a product, which features the title of the song and an image of the singer to associate the article with the artist and single and to illustrate the way the song was promoted. The original cover art was produced for the express purpose of identifying and associating thusly, and therefore this usage is in keeping with its original intent. Furthermore, the image was not the original product (the product being the song) and so the image's use does not deprive the owners of that product, the song, from fair control and just remuneration. In fact, if anything, the usage of such photographs would serve to interest potential music buyers, and cohere an impression of an artist as they were marketed by the record company at the time, and certainly not dissuade, prevent, or negate such a potential purchase.

This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question. It is believed that the use of low-resolution images of such covers

Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:
- It illustrates educational articles about the album from which the cover illustration was taken.
- The image is used as the primary means of visual identification of the article topic.
- The use of the cover will not affect the value of the original work or limit the copyright holder's rights or ability to distribute the original. In particular, copies of the image could not be used to make illegal copies of the album artwork on another CD as it is merely an inset of the cover.
- It is a low resolution image and merely an inset of the cover.
- The image is only a small portion of the commercial product.
- It is not replaceable with an uncopyrighted or freely copyrighted image of comparable educational value.
