The use of this audio recording cover in the article The Birds & The B-Sides, is believed to be fair use, for the following reasons:
- This reproduction of the cover is of inferior resolution and quality to the original, and could not be used as an adequate replacement for the original.
- The image is used only to represent the audio recording in question, in an article which makes explicit and extensive reference to it, adding significantly to the educational content of the article.
- No free equivalent is available or could be created that would adequately give the same information as an image such as this, is by its nature, irreplaceable.
- The image is freely available from many other sources on the internet and its inclusion here does not to make it substantially more accessible than it already is.
- The use of the image here does not limit the copyright holder's ability to distribute, sell or promote the recording in any way.
- Copies could not be used to make illegal copies of the cover artwork on another CD.
