These two booking photos of Ted Binion have been used over and over by media across the world -- in Ireland, England, Germany, and America -- and are public documents, released with no conditions by the Las Vegas Metro Police Department. They were put in the public domain long before Scott's book was released. Mug shots in Las Vegas fall under the public domain by Nevada's open public records statute.

This image is a booking photo, more commonly known as a mug shot, normally produced in the regular operations of a law enforcement agency or correctional facility. It is believed that the use of this photograph

to illustrate the booking consistent with non-free content criteria,
where no free alternative exists or could be created,
on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation,
