It is contended that the use of this DVD cover in List of The Big O media qualifies as fair use for the following reasons:

1. This image illustrates the cover of the DVD of the series of which the list is about
2. This image can be used to identify the series
3. It does not limit the copyright owner's rights to market or sell the DVD in any way.
4. The image is of lower resolution than the original cover.
5. The image is being used in an informative/educational way and does not detract from sales of the series in any way.
6. No free or public domain images have been located or are known to exist for this DVD
