Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

  1. It is a historically significant photo of a famous individual, Jules Bergman, at work on television doing what he was best known for (reporting on space topics).
  2. No other image is available.
  3. It is of lower resolution than the original (copies made from it will be of very inferior quality).
  4. It is only a portion of the original screen image.
  5. The photo is only being used for informational purposes.
  6. Its inclusion in the article adds significantly to the article because the person depicted in the photograph is the subject of discussion in the article.
