This was taken from rateyourmusic.com, a site which features many album covers. This is used to simply illustrate the cover of a single, and is in accordance with the fair use rationale. There are many other covers of this nature on Wikipedia, and this one is just as "legal" as the others.

This image is of a cover of an audio recording, and the copyright for it is most likely owned by either the publisher of the album or the artist(s) which produced the recording or cover artwork in question.
