Though this image is subject to copyright, its use is covered by the U.S. fair use laws because:

1. It is of much lower resolution than the original (copies made from it will be of very inferior quality).
2. The photo is only being used for informational purposes.
3. it is "unrepeatable", as one of the pictured musicians (blonde lady at right) has left the orchestra since the publicity photograph was taken, and would no longer be included in current publicity photographs as an orchestra member.
