Portion used |
As per Kelly v. Arriba Soft Corporation: (1) The reproduction in thumbnail format is sufficiently transformative from the original to constitute fair use/abridgment; (2) The image has already been published, reducing its significance as a creative work; (3) It is not a "full" replication of a copyrighted work, as the smallest typeface print is rendered unreadable. (4) The market for and value of the original photograph/drawing will not be substantially diminished by the publication of this image which has been reduced in resolution. |
Low resolution? |
Yes, well below the 0.1MB threshold. |
Purpose of use |
Illustration of the marketing of a benzodiazepine, lorazepam to physicians. Here, physicians are referred to as "clinicians", a reminder that they are the ones who know their patients, able to identify those who deserve this caring intervention, and able to weigh up benefits vs drawbacks of the prescription. The advert provides reassurance to clinicians that they are "caring" when they go ahead and prescribe lorazepam (increasingly recognised as dependence forming) to relieve anxiety associated with the normal life stress of existential crisis. |
Replaceable? |
This is an image of a historical advertisement and is not replaceable by a newly produced non-copyrighted image. |
Other information | In terms of marketing sophistication, it is sophisticated and subtle, contrasting sharply with a less sophisticated, direct-to-consumer advertisement for Lorazepam from 1977. See http://en.wikipedia.org/wiki/Image:Ativan77.jpg |
