Hi, sorry I didn't notice your message. The question that you have to ask when you look at an image is, "Can I replace it with something freer?" By freer, I mean a photo taken of the actor in his private life, or even on set, but not in a copyrighted photo of a character. See Martin Sheen or David Caruso for examples. However, the image of the character, i.e. Kingpin, is cannot be replaced by a freer image, that image is as free as it gets. Hope that answers your question.
