I, szyslak, feel this image qualifies as fair use because:
- It uses a very small portion of the copyrighted work, the film Conquest of the Planet of the Apes. It does not reveal the film's ending or otherwise abridge the copyright holder's rights.
- It illustrates an important aspect of its subject, University of California, Irvine: to wit, that its campus buildings have been used as the setting for Conquest of the Planet of the Apes, a major motion picture.
- As a film screenshot, it is inherently not replaceable by a free content image.

This image is a screenshot from a copyrighted film, and the copyright for it is most likely owned by the studio which produced the film, and possibly also by any actors appearing in the screenshot. It is believed that the use of a limited number of web-resolution screenshots
