  1. it is not a commercial photo, being a family photo released to the media by Cobby's family, thus no commercial loss will be suffered
  2. the photo is only being used for informational purposes
  3. its inclusion in the article adds significantly to the article, providing an image of Cobby that would not otherwise be available
