The image in question is subject to a copyright. However, the use of the image on these three articles qualifies as fair use for these reasons:

It is a low-resolution copy of an album cover
It does not limit the copyright holder's ability to sell the album in any way
There is no free alternative to replace the use of this image
- On America (album), there is no substitute for the cover image
- On A Horse With No Name, there was no separate cover art for the single, so the album from which the single came from is the only choice
- On America (band), it is the only way to depict the band's lone #1 album.
