[edit] Summary

Low-res version of copyrighted picture of Alfred Nakache by Serge Gilard. This picture, posted on the website Mr. Serge Gilard memories (in french) here. Mr. Gilard says in his site (in french) he wants his memories and experiences to be known to the public, including the memories of his chlidhood hero - Alfred Nakache, "the swimmer from Auschwitz" as he calles him (Le "nageur d'Auschwitz").
Although the permition to use the image was not explicity given; I presume that a low-res cropped version of the photo of would be covered by fair use for use in Alfred Nakache because Nakache is deceased, a notable person of historical importance, and no other picture is available. This rationale for fair use only for the purpose of illustrating Alfred Nakache in the article about him.

A larger and better version of this picture can be found on the owners's website. The larger version is clearly labeled as being copyrighted.
