In general baseball cards do not fall under fair use because the copyright is still held by Topps, Fleer, Upper Deck, etc. Posting images of their cards would probably be considered to be in violation of their copyright. Older baseball card from the 1800's early part of the 20th century can sometimes be used as the images have fallen into the public domain because of their age. The Topps permission is useless to us, because it applies only to Wikipedia, not to any downstream users, or even other Wikimedia projects, such as Wikinews or Wikibooks. That's why we want real licenses like GFDL or CC, not vague permissions. Stan 04:58, 26 March 2006 (UTC)

Hi. I don't believe that this letter provides adequate justification for use of the images of Topps baseball cards on Wikipedia. Though I'm unsure what your original query to the Topps legal staff was, I can only assume that it was not adequetly explained that Wikipedia is licensed under the GFDL and thus cannot use works or images that are not released under a compatible free license, aside from the rare items that can be used under the fair use doctrine of US law. Please retag these images properly in accordance with Wikipedia:Image copyright tags and Wikipedia:Image use policy, or they will have to be deleted. There's a need for a fix in the Greg Keagle article. It says he pitched the first no-hitter in Elmira Pioneers history, but there was actually 3 no-hitters pitched by the Pioneers in 1965. There's more about this in the Greg Keagle talk page.--Ando por Fe 17:26, 24 May 2007 (UTC)
