It is contended that the use of this image in the article on Hans Albers qualifies as fair use for the following reasons.

  1. This inidividual is dead and due to short length of time since death it is unlikley that any free alternatives exist in the public domain.
  2. This image is of fairly low resolution
  3. This image is used for educational purposes in the article on Hans Albers
  4. This image is used to identify the subject of the article on Hans Albers and the identification that this image provides could not be comparably completed with prose alone.
  5. Identificaiton of the subject of this article could not comparably be completed via prose alone.
  6. This image should not detract from any resale value this image may have

From the article: "Outside of Northern Europe, however, Albers remains virtually unknown, although the image of an older man in a seaman's cap and raincoat playing accordion and singing may be recognised by many outside of Germany, even if they don't know that this image is based on Hans Albers. As a case in point, McDonald's used such an image in an American television ad campaign in 1986."

This is one of the classic images of Albers, showing his persona more or less as described above.

The album whose cover is used here is a compilation of Albers's best known seafaring songs which is no longer available. Thus, publication of this image in his biographical article has no negative influence whatsoever on the sale of that album.

The image is of low resolution.
