[edit] Fair use in Aguirre, the Wrath of God

This image, AguirrePoster.jpg, is being linked here; although the picture is subject to copyright I (Hal Raglan) feel it is covered by the U.S. fair use laws because:

  1. This image illustrates the text next to which it appears, which describes the film in question for which it promotes.
  2. Specifically, the poster illustrates how the film was initially promoted/advertised in the United States. As the text discusses the film's domestic release, and notes how the film quickly developed into a cult film, it is important that an example of how the film was sold be provided.
  3. It is of much lower resolution than the original (copies made from it will be of very inferior quality).
  4. It does not limit the copyright owner's rights to market or sell the work in any way.
  5. This image is used on various websites, so its use on Wikipedia does not make it significantly more accessible or visible than it already is.
  6. The image is being used in an informative way and should not detract from the original work.
  7. No free or public domain images have been located for this item.-Hal Raglan 04:01, 14 March 2007 (UTC)
