The specific authorship of this work is unknown to anyone, but it is unlikely that any foreign copyright has ever applied to this nineteenth century portrait of a British Columbian. -If copyright was established in the United States through publication prior to 1923, this image would by now be in the public domain in the US. 2. In the event that a portrait copy-right holder did appear, its use to illustrate the article Alexander Edmund Batson Davie would be fair use because: -the photo is only being used for informational purposes. -the photo is of much lower resolution than the original -The subject is dead-- is would be impossible to create a new free-use image -the content is not used in a manner that is likely to replace the original market role of the original copyrighted media.
